The proper integration of indispensable joinder ensures procedural validity and the effectiveness of judicial rulings, as these disputes directly impact the rights of all involved parties. Its omission leads to nullity, given that judicial decisions would lack enforceability without the participation of every necessary party. Ecuador’s General Organic Code of Procedures (COGEP), at the Ecuador, provides clear regulations regarding its formation; however, its practical application demands a thorough doctrinal analysis, particularly in complex scenarios involving the indivisibility of the procedural object or inseparable legal ties. This analysis emphasizes the importance of interpreting indispensable joinder in a manner that balances procedural technique with the principles of due process and effective judicial protection, preventing contradictory or ineffective rulings that may undermine legal certainty.
