Regulatory Recommendations regarding Legal and Ethical Implications of Sentence 67-23-IN/24 of the Constitutional Court of Ecuador on Euthanasia

The general objective of this study was to evaluate the proposed normative about the modification Ruling 67-23-IN/24 by the Constitutional Court of Ecuador regarding euthanasia and to determine its viability within the Ecuadorian legal framework. For this, a mixed methodology was employed that combined empirical and theoretical approaches, including surveys of legal operators and analysis of legal documents, which allowed for a deep understanding of the causes and conditions that led to the ruling and the implications of its implementation. The main results indicate that the Court's decisions are consistent with the Constitution and previous jurisprudence, ensuring the stability and predictability of the legal system. Additionally, possible positive and negative impacts on fundamental rights were identified, underscoring the need for any limitation on certain rights to be justified and proportional to the pursued objectives, aligning with international human rights standards. The modification proposal received a high evaluation, scoring 9.5 out of 10, showing high viability and clarity. It is concluded that it is crucial that normative recommendations are not only legally adequate but also achieve an effective balance between ethical and legal implications, ensuring that the voices of all sectors involved are considered in the legal process.
