Seguridad ciudadana en México: una análisis desde los derechos humanos y el realismo institucional

Resumen

La construcción del pensamiento legal destinado en atender el alto índice de la inseguridad; se orienta en representar la doctrina y la autoridad estatal, donde se ponen en tensión la eficacia de la autoridad en relación con el éxito al combate al crimen y la otra en el respeto irrestricto de los derechos humanos. El objetivo de esta investigación fue analizar la seguridad ciudadana en México particularmente se realizó un análisis desde los derechos humanos y el realismo institucional. La metodología utilizada fue descriptiva documental mediante el estudio de los textos constitucionales y legales. Los resultados dan cuenta que existe un dilema actual desde el crimen organizado donde los derechos humanos coexisten desde un Estado democrático de derecho. Se concluye que el posicionamiento jurídico de la seguridad ciudadana está vinculado a la naturaleza de los derechos humanos y las dinámicas institucionales que desde lo legal asume características sociales propias.

ABSTRACT

The construction of legal thought destined to address the high rate of insecurity; It is oriented to represent the doctrine and the state authority, where the effectiveness of the authority in relation to the success in the fight against crime and the other in the unrestricted respect of human rights are put in tension. The objective of this research was to analyze citizen security in Mexico, particularly an analysis from human rights and institutional realism. The methodology used was descriptive documentary through the study of constitutional and legal texts. The results show that there is a current dilemma from organized crime where human rights coexist from a democratic State of law. It is concluded thatThe legal position of citizen security is linked to the nature of human rights and the institutional dynamics that, from the legal point of view, assume their own social characteristics.
