Challenges in electronic procurement: agreements and legitimacy

The optimization of time and resources is a maxim that humanity has been perfecting in its daily actions. The COVID-19 pandemic led to an increase in electronic contracting around the world, Ecuador was not immune to this process. A fundamental element in this process is the autonomy of the will between the parties in these digital contracts. The objective of this paper is to assess the presence of autonomy of the will in electronic contracts in Ecuador. To this end, various techniques were applied, such as the survey, interview and the IADOV technique. It was determined that there are several gaps in terms of the need for autonomy of will in electronic contracting. Actions are proposed to increase the autonomy of the will in electronic procurement.
