Relevance of modifying the local ordinance for the protection of urban fauna in the Tulcán Canton

Abstract

The recognition of animals as subjects of rights in Ecuador is a significant advance in the protection of animal welfare and reflects a change in the cultural and legal perception about the relationship between humans and animals. In the Tulcán canton, different forms of animal treatment have been observed, such as being run over, poisoning, abandonment, and overpopulation in certain spaces. Therefore, the objective of this research is to analyze the efficiency of the local ordinance issued by the GAD of the Tulcán canton, specifically designed for the protection of urban fauna, evaluating its impact on the reduction of animal abuse, the promotion of responsible ownership, and the promotion of peaceful coexistence between humans and fauna. The current ordinance lacks clear and precise wording that allows its proper interpretation and application by the competent authorities, generating confusion and difficulties in its compliance. It has several flaws in terms of its application, so it is considered pertinent to make a modification to this Ordinance, so that its implementation and supervision mechanisms are perfected. Poor training of enforcement personnel and the lack of an adequate monitoring system have limited the scope of the measures provided for in the ordinance.
