Integral repair for indirect victims in the ecuadorian criminal justice system

Comprehensive reparation to victims of crimes are the measures imposed on the offender by the judge, in favor of the victim, with the aim of restoring the damage caused, disappearing its effects and guaranteeing its non-repetition and are established as a consequence of the commission of a crime illicit. This article analyzes the comprehensive reparation of indirect victims in the Ecuadorian criminal justice system, information obtained on the basis of bibliographic, field, applied and heuristic documentary research that allows us to identify whether judges and magistrates when resolving cases Criminal processes determine comprehensive reparation in favor of direct and indirect victims of crime. The results obtained reveal that at the time of filing the complaint and during the criminal process, the lawyers do not request comprehensive reparation for the direct victims and much less for the indirect victims, it is determined that in the cases in which the judges impose measures of protection in favor of the victims, only economic reparation is considered, completely leaving aside psychological support to overcome the violation of their rights, there is also talk of the lack of application of national and international standards related to comprehensive reparation by justice operators; information obtained through the application of the research instrument to the magistrates, judges, prosecutors and public defenders of the city of Riobamba, in order to obtain their legal criteria in this regard.
