Model for improving the public management of the Peruvian State due to non-compliance with supranational ruling

Abstract

The study focused on identifying the deficiencies that exist in the set of processes, policies and strategies implemented in the administration of government resources and services, which do not facilitate the government in office to comply responsibly with the agreements made with the international environment, especially in cases of human rights violations. The objective of the study was to develop a proposal that provides strategies to improve the levels of compliance with the final result issued by the supranational Jurisdiction, in order to reduce uncertainty for those who have been demanding justice for years. This research used an applied methodology of non-experimental events, with a descriptive quantitative approach, cross-sectional and projective, its population consisted of 42 cases (91.30%) that were in the Repository of the IACHR Court, under compliance supervision of the Peruvian State. As main evidence, it highlights that the State continues to fail to repair the damage caused to its victims and international agreements, in respecting the fundamental rights of its citizens. In the discussion, the ineffectiveness of the State in maintaining obsolete and abusive internal norms that need to be modified is noted. Peruvian government management must plan its decisions in order to assume international responsibilities. It was recommended as a strategy improvement to allocate an item in the “Annual Budget of the State” in order to comply with repairing the damage caused to its victims and compensate them in a timely manner, according to the “Principle of Budgetary Management”, which will allow them to carry out an effective management, exclusive to the international commitments assumed.
