Trastornos afectivos a causa de un divorcio unilateral, un estudio en la provincia de Tungurahua, Ecuador.

Resumen

La investigación aborda una alternativa que ha sido implementada por varias legislaciones a nivel mundial para dar por terminado el vínculo matrimonial: el divorcio incausado. Se planteó como objetivo conocer la necesidad de establecer un tiempo adecuado para la toma de decisiones en el caso del divorcio unilateral sin causales, para garantizar el derecho a la salud mental de los cónyuges y el de los miembros del núcleo familiar. Para lo cual se trabajó bajo una investigación cuantitativa, con enfoque no experimental de tipo transversal con la técnica de la encuesta a profesionales del Derecho y a profesionales de la salud mental de la provincia de Tungurahua. Como principal resultado se confirma la importancia de determinar un tiempo de 6 meses para antes de dar por culminado el vínculo matrimonial con el objetivo de poder descartar o en su defecto tratar las patologías asociadas a la salud mental que influyan en la toma de decisiones tanto de demandantes como demandados respecto a su situación conyugal.

ABSTRACT

This research addresses an alternative that has been implemented by several legislations worldwide to terminate the marital bond, we are talking about the uncontested divorce. The objective of the research was to determine the need to establish an adequate time for decision making in the case of unilateral divorce without grounds, in order to guarantee the right to mental health of the spouses and the members of the family nucleus. For which we worked under a quantitative research, with a non-experimental approach of transversal type with the technique of the survey to law professionals and mental health professionals of the province of Tungurahua. The main result confirms the importance of determining a time of 6 months before terminating the marital relationship in order to rule out or treat pathologies associated with mental health that influence the decision making of both plaintiffs and defendants regarding their marital situation.
