Los contratos inteligentes y su incorporación en ordenamiento jurídico Smart contracts and their incorporation into the legal system

Resumen

Los contratos inteligentes surgieron con el desarrollo del blockchain, e hicieron posible que los acuerdos contractuales se cumplan automáticamente, sin intervención de un tercero. El presente trabajo tiene por objetivo, analizar la incorporación de los Smart contracts en el ordenamiento jurídico, confrontándolos con la teoría del contrato; siendo relevante por la poca bibliografía jurídica sobre los mismos, la disponible proviene de países asiáticos y anglosajones, siendo necesario abordar este problema por doctrinarios latinoamericanos y así proveer de herramientas que permitan la actualización de nuestros sistemas jurídicos. La metodología es cualitativa, se utilizó el método hermenéutico que permitió el análisis de los documentos. Se concluyó que los smarts contracts pueden ser considerados contratos desde el punto de vista legal, pero con características propias dad su naturaleza tecnológica. Dentro del ordenamiento jurídico se ubicarían en el derecho privado con difícil intervención del Estado en caso de incumplimiento.

ABSTRACT

Smart contracts emerged with the development of the blockchain, and made it possible for contractual agreements to be fulfilled automatically, without the intervention of a third party. The present work aims to analyze the incorporation of Smart contracts in the legal system, confronting them with the contract theory; being relevant because of the little legal literature on them, the available one comes from Asian and Anglo-Saxon countries, being necessary to address this problem by Latin American doctrinarians and thus provide tools that allow the updating of our legal systems. The methodology is qualitative, the hermeneutic method was used, which allowed the analysis of the documents. It was concluded that smarts contracts can be considered contracts from the legal point of view, but with their own characteristics due to their technological nature. Within the legal system they would be placed in private law with difficult intervention of the State in case of non-compliance.
