La Constitución Ecuatoriana y los principios democráticos

Resumen

Lo que conocemos como soberanía, cuya voluntad nace del pueblo, siendo el fundamento de la autoridad aquella voluntad, para ejercer y desempeñar las funciones y competencias conferidas por el pueblo dentro del marco de la Constitución y la Ley, a través de las diferentes formas de participación del pueblo, sea esta representativa, directa y comunitaria, todas se orientan bajo los principios democráticos. La democracia, es el pilar fundamental en la formación de un Estado, y, por ende, la administración de un gobierno, toda vez que se crea el poder político del pueblo, para el pueblo; dicho de otra forma. Por lo tanto, el objetivo del presente trabajo es realizar un estudio de tales principios, estableciendo cuales son y lo que comprende cada uno de ellos, con un alcance descriptivo y explicativo, acompañado del método hermenéutico jurídico, para indicar la trascendencia y relevancia de cómo operan en la Carta Fundamental ecuatoriana.

ABSTRACT

What we know as sovereignty, whose will is born of the people, being the foundation of the authority that will, to exercise and perform the functions and powers conferred by the people within the framework of the Constitution and the Law, through the different forms of participation of the people, whether representative, direct and community, all are oriented under democratic principles. Democracy is the fundamental pillar in the formation of a State and, therefore, the administration of a government, since it creates the political power of the people, for the people; in other words. Therefore, the objective of the present work is to carry out a study of such principles, establishing what they are and what each one of them comprises, with a descriptive and explanatory scope, accompanied by the legal hermeneutic method, to indicate the transcendence and relevance of how they operate in the Ecuadorian Fundamental Charter.
