La extinción del acto administrativo por nulidad absoluta como condición para la imposibilidad de su ejecutoriedad

Resumen

Los actos administrativos gozan de las presunciones de legitimidad y ejecutoriedad, es decir, que se presume que fueron dictados legalmente, por tanto, estos deben cumplirse una vez que han sido expedidos, la falta de notificación constituye un hecho administrativo viciado por parte del servidor público responsable de la notificación. Es decir, que el vicio no recae en el acto administrativo como tal, sino en las actuaciones de responsabilidad de la administración pública. Sobre este particular, se debe diferenciar lo que es un acto administrativo y lo que es un hecho administrativo. Según la normativa de la administración pública, como lo es el Código Orgánico Administrativo, la solo presunción de los actos administrativos regulares permite su eficacia, por ende, su ejecutividad.

Administrative acts have the presumptions of legitimacy and enforceability, that is, it is presumed that they were legally dictated, therefore, they must be complied with once they have been issued, the lack of notification constitutes a flawed administrative fact on the part of the public servant responsible for the notification, that is, that the vice does not fall on the administrative act as such, but on the actions of responsibility of the public administration; On this matter, it is necessary to differentiate between what is an administrative act and what is an administrative act, in short, according to the regulations of the public administration, such as the Organic Administrative Code, the only presumption of regular administrative acts allows their effectiveness, hence, its enforceability.
