Influencia del derecho canónico en los sistemas jurídicos latinoamericanos: análisis desde el pluralismo jurídico

Resumen

En la edad media existía pluralismo jurídico, superado con el Estado Nación que monopoliza la facultad legislativa y regula al hombre en sociedad, sin embargo, este hecho, no contradice que las personas forman parte de diferentes instituciones, como la Iglesia católica; la cual tiene sus propias normas o reglas, que demandan ser cumplidas por sus miembros. A partir de la globalización resurge el pluralismo jurídico, que hace que las personas se encuentren bajo la regulación de una variedad de sistemas jurídicos. El objetivo de la investigación es realizar un análisis jurídico de la influencia del Derecho canónico en los sistemas jurídicos latinoamericanos. La investigación sigue un enfoque cualitativo, con alcance explicativo, de tipo documental, pero a la vez proyectivo, ya que, pretende evidenciar el futuro de las interacciones del objeto de estudio. Se utilizan los métodos generales de la investigación como el analítico sintético y sistémico. En cuanto la población de estudio se tomó el ordenamiento jurídico latinoamericano, como caso de estudio. Se obtuvo como resultado que el ser humano es integral y es regulado por diversos sistemas jurídicos, los cuales le aportan valores que se reflejan en la construcción y fundamentación e interacción entre los diversos sistemas regulatorios que conforman el orden jurídico.

ABSTRACT

In the Middle Ages there was juridical pluralism, overcome with the Nation State that monopolizes the legislative power and regulates man in society, However, this fact, does not contradict that people are part of different institutions, such as the Catholic Church, which has its own norms or rules, which demand to be complied with by its members. With globalization, legal pluralism has re-emerged, which means that people find themselves under the regulation of a variety of legal systems. The objective of this research is to carry out a legal analysis of the influence of canon law in Latin American legal systems. The research follows a qualitative approach, with an explanatory scope, of documentary type, but at the same time projective since it intends to evidence the future of the interactions of the object of study. General research methods such as synthetic and systemic analytical methods are used. As for the study population, the Latin American legal system was taken as a case study. The result was that the human being is integral and is regulated by various legal systems, which provide values that are reflected in the construction and foundation and interaction between the various regulatory systems that make up the legal order.
