Material damage in traffic accidents: legal analysis of the impact on the principle of speed

Criminal traffic violations occur for serious conduct that violates road rules, such as speeding, driving under the influence of substances, disobeying signs, or mechanical failure. These situations are caused by human, technological, environmental and social factors. In addition, the lack of road safety education, insufficient inspection and corruption contribute to its frequency. These violations generate severe consequences: loss of life, permanent injuries, property damage, economic costs and judicial overload. Furthermore, the impact on the principle of speed violates the rights of the parties as significant delays are reflected in the resolution of cases, which generates distrust in the administration of justice. For the purposes of the study, the type of qualitative, descriptive and explanatory research was used, in addition to the inductive-analytical and field methods, through the survey. The results of this investigation demonstrated that criminal traffic violations generate a significant impact on the procedural burden and violate the principle of speed, especially due to the lack of resources and technical complexity. It is concluded that the implementation of technology, regulatory reform and the use of alternative methods to alleviate the judicial system are highlighted as priority solutions. These findings underscore the need for immediate actions to optimize the management of these cases.
