El error inexcusable en la legislación ecuatoriana

Abstract

Con el objetivo de analizar la figura jurídica del error inexcusable en el contexto legislativo ecuatoriano, se desarrolló un estudio descriptivo de tipo revisión bibliográfica, con enfoque cuanti-cualitativo, sistematizado mediante los métodos de investigación científica: exegético, hermenéutico, analítico–sintético y estadístico. Los hallazgos obtenidos permitieron determinar que la figura jurídica del error inexcusable ha sido tema de reflexión y polémica en los últimos tiempos, existen criterios encontrados por parte de juristas, algunos abogan por su inclusión en el ordenamiento jurídico, otros por su exclusión; pero lo que es una realidad es la necesidad de eliminar el vacío en la ley y regular el órgano idóneo para establecerlo y sancionarlo.

ABSTRACT

With the objective of analysing the legal figure of the inexcusable error in the Ecuadorian legislative context, a descriptive study was developed of type bibliographic review, with a quantitative-qualitative approach, systematized by means of scientific research methods: exegetical, hermeneutic, analytical, synthetic and statistical–. The results obtained allowed to determine that the legal figure of the inexcusable error has been a topic of reflection and controversy in recent times, there are conflicting criteria on the part of jurists, some advocate its inclusion in the legal system, others for its exclusion; but what is a reality is the need to eliminate the gap in the law and regulate the organ suitable to establish and sanction it.
