Manifestaciones exclusivas contra la comunidad LGBTIQ+ de frente a su protección jurídica en Ecuador

Resumen

Este artículo examina las manifestaciones exclusivas que enfrenta la comunidad LGBTIQ+ en Ecuador en relación con su protección jurídica. A pesar de los avances legales significativos logrados en los últimos años para salvaguardar los derechos de esta comunidad, aún persisten desafíos y manifestaciones de discriminación y exclusión. Actualmente se ha podido comprobar que a pesar de las reformas legales en beneficio de la comunidad LGBTIQ+ en Ecuador, continúan las manifestaciones de exclusión y violencia. A razón de esta situación se examinan los desafíos en el ámbito social y cultural que dificultan la plena integración de esta comunidad en la sociedad ecuatoriana. Se analizan los obstáculos que persisten en el sistema de justicia ecuatoriano en relación con los delitos de odio y la protección de los derechos de la comunidad LGBTIQ+. Para el desarrollo de la investigación se utilizaron métodos investigativos de la modalidad cualitativa, aportando las herramientas necesarias para el logro y codificación de la información que tributó al resultado de este artículo. Se determinó que es necesaria una acción continua y coordinada de diversos actores sociales, políticos y jurídicos para garantizar la igualdad y la inclusión plena de las personas, sin importar su orientación sexual o identidad de género.

ABSTRACT

This article examines the exclusive manifestations faced by the LGBTIQ+ community in Ecuador in relation to their legal protection. Despite the significant legal advances made in recent years to safeguard the rights of this community, challenges and manifestations of discrimination and exclusion still persist. Currently it has been possible to verify that despite the legal reforms for the benefit of the LGBTIQ+ community in Ecuador, the manifestations of exclusion and violence continue. Because of this situation, the challenges in the social and cultural sphere that hinder the full integration of this community in Ecuadorian society are examined. The obstacles that persist in the Ecuadorian justice system in relation to hate crimes and the protection of the rights of the LGBTIQ+ community are analyzed. For the development of the research, investigative methods of the qualitative modality were used, providing the necessary tools for the achievement and codification of the information that contributed to the result of this article. It was determined that a continuous and coordinated action of various social, political and legal actors is necessary to guarantee equality and full inclusion of people, regardless of their sexual orientation or gender identity.
