Personas privadas de la libertad y su traslado injustificado: perjuicio a la relación social y familiar.

Resumen

La Constitución Ecuatoriana señala que el Estado tiene cómo deber fundamental garantizar los derechos, principios y garantías constitucionales, por ende en el presente caso al hablar de personas privadas de libertad, quienes pertenecen al grupo de atención prioritaria, reconoce el acceso a la comunicación y visita de sus familiares, disposición constitucional que en varias ocasiones ha sido vulnerada por los traslados injustificados, anti técnicos e inmotivados por parte de los Centros de Rehabilitación Social, afectando de esta manera el derecho a la seguridad jurídica, a la comunicación con los abogados patrocinadores, causando un daño eminentemente incomparable e irreversible tanto en el aspecto psicológico y el aspecto social, también viéndose afectados los familiares de las personas privadas de la libertad. Es necesario realizar un análisis profundo de investigación, basándonos en bibliografía, tesis, artículos científicos y casos prácticos que se han suscitado en el Centro de Rehabilitación Social de Tulcán, con esto nos permite recabar información veraz y eficaz para el desarrollo y aplicación del presente proyecto de investigación.

ABSTRACT

The Ecuadorian Constitution states that the State has as a fundamental duty to guarantee the rights, principles and constitutional guarantees, therefore in the present case when talking about persons deprived of liberty, who belong to the priority attention group, it recognizes the access to communication and visitation of their relatives, constitutional provision that on several occasions has been violated by unjustified transfers, This constitutional provision has been violated on several occasions by unjustified, anti technical and unmotivated transfers by the Social Rehabilitation Centers, thus affecting the right to legal security, to communication with the sponsoring attorneys, causing an eminently incomparable and irreversible damage both in the psychological and social aspect, also affecting the relatives of the persons deprived of liberty. It is necessary to carry out a deep research analysis, based on bibliography, thesis, scientific articles, and practical cases that have occurred in the Social Rehabilitation Center of Tulcán, which allows us to gather truthful and effective information for the development and application of this research project.
