El rol de la rehabilitación social en los Centros Penintenciarios de Ecuador

Resumen

El presente trabajo investigativo fue direccionado a analizar el rol de la rehabilitación social en los centros penitenciarios de Ecuador en su cumplimiento a lo establecido en la Constitución de la República del Ecuador, cuya finalidad es la rehabilitación integral de las personas sentenciadas penalmente para reinsertarlas en la sociedad. Se realizó una investigación cualitativa, analizando documentos, textos legales, etc., que formaron parte para la realización de este trabajo. Concluyendo, que a pesar de las recomendaciones que viene realizando la Corte Interamericana de Derechos Humanos, y de la creación de políticas públicas, en Ecuador no existe una verdadera rehabilitación social, para que, una vez cumplida la pena impuesta, el sentenciado, consiga un cambio en su vida, y logre convivir en sociedad, no transgrediendo Ley Penal. Los problemas que se presentan en el Sistema Penitenciario, es no contar con los recursos económicos suficientes, falta de más empleados para cubrir las plazas técnicas y de tratamientos, además la escasez de personal de vigilancia y seguridad impide la rehabilitación de las personas privadas de libertad. Más aún cuando existe hacinamientos.

ABSTRACT

The present research work was directed to analyze the role of social rehabilitation in the penitentiary centers of Ecuador in its compliance with the provisions of the Constitution of the Republic of Ecuador, whose purpose is the comprehensive rehabilitation of persons sentenced criminally to reintegrate them into society. Qualitative research was carried out, analyzing documents, legal texts, etc., which were part of this work. We concluded that despite the recommendations made by the Inter-American Court of Human Rights and the creation of public policies, in Ecuador there is no real social rehabilitation, so that once the sentence is served, the sentenced person achieves a change in his life, and manages to live in society, not transgressing criminal law. The problems in the Penitentiary System are the lack of sufficient economic resources, the lack of more employees to cover the technical and treatment positions, as well as the lack of surveillance and security personnel, which prevents the rehabilitation of the persons deprived of liberty. Even more so when there is overcrowding and the governance of criminal organizations in detention centers.
