Protection of the rights of children in compliance with maintenance obligations
Abstract
The non-payment of alimony has been defined as a problem that has affected many families, generating an intense debate about the appropriate measures to guarantee compliance with this obligation. While the deprivation of liberty for non-payment of alimony has been one of the most controversial sanctions, raising divided opinions about its justice and effectiveness. Therefore, the present study has focused on analyzing the results of a survey carried out, by exploring the perceptions and experiences of the respondents. As well as possible alternatives and reform proposals to guarantee compliance with food obligations and promote the well-being and development of children. Among the observed results, main barriers have been identified such as social stigmatization, lack of adequate training and economic limitations. In addition, alternatives have been proposed, such as family mediation and financial support, that could improve compliance with maintenance obligations without resorting to punitive measures such as prison. Indeed, it has been concluded that it is imperative to reform policies and strengthen training and employment programs to equip individuals with relevant skills, thereby facilitating effective and sustainable reintegration. Likewise, the need to adopt humanitarian approaches that protect the rights of children and promote social cohesion in affected communities has been emphasized.
