Reconfiguración del estado ecuatoriano, un análisis descriptivo y analítico hacia el neoconstitucionalismo

Abstract

Este estudio adopta un enfoque descriptivo y analítico para examinar la reconfiguración del Estado ecuatoriano desde 2008 hasta la actualidad, centrándose en la transición hacia el neoconstitucionalismo desde un modelo basado en la teoría kelseniana y liberal. La investigación se basa en un análisis exhaustivo utilizando documentos oficiales, leyes y análisis académicos relacionados con el cambio constitucional en Ecuador. Los resultados revelan que, a partir de 2008, Ecuador experimentó una reconfiguración de su estructura estatal, exigiendo cambios legales, institucionales y culturales. El neoconstitucionalismo en Ecuador se manifestó con el golpe de Estado contra el presidente Lucio Gutiérrez en 2005 y la posterior Asamblea Constituyente de 2007-2008. Sin embargo, la implementación práctica del neoconstitucionalismo enfrenta desafíos, y la desconexión entre la norma suprema y la realidad persiste. La efectividad de los derechos aún requiere atención para lograr un verdadero Estado constitucional.

 ABSTRACT

This study adopts a descriptive and analytical approach to examine the reconfiguration of the Ecuadorian State from 2008 to the present, focusing on the transition towards neoconstitutionalism from a model based on Kelsenian and liberal theory. The research is based on an exhaustive analysis using official documents, laws and academic analyzes related to constitutional change in Ecuador. The results reveal that, starting in 2008, Ecuador experienced a reconfiguration of its state structure, requiring legal, institutional and cultural changes. Neoconstitutionalism in Ecuador manifested itself with the coup d'état against President Lucio Gutiérrez in 2005 and the subsequent Constituent Assembly of 2007-2008. However, the practical implementation of neoconstitutionalism faces challenges, and the disconnection between the supreme norm and reality persists. The effectiveness of rights still requires attention to achieve a true constitutional State.
