La seguridad jurídica y los paradigmas del estado constitucional de derechos

Resumen

La investigación se basó en un estudio comparado de los términos jurídicos que vienen sustanciándose en procesos en donde la seguridad jurídica conjuntamente con la justicia y el bien común se constituyen en uno de los fines del Derecho. Sin embargo, el cumplimiento de estos fines solo se explica en tanto el hombre se relaciona con otros individuos, en razón de que la norma jurídica tiende a crear un determinado orden social, propiciando dentro de él, cierto tipo de conducta que propenda a un Estado de paz. El objetivo principal de este trabajo investigativo es analizar los componentes epistemológicos de la Seguridad Jurídica en el marco de los nuevos paradigmas del Estado Constitucional de Derechos.

ABSTRACT

The research was based on a comparative study of the legal terms that have been based on processes where legal security, together with justice and the common good, constitute one of law purposes. However, the fulfillment of these purposes is only explained as long as man is related to other individuals, because the legal norm tends to create a certain social order, promoting within it, a certain type of behavior that tends to a State of peace. The main objective of this research work is to analyze the epistemological components of Legal Security in the framework of the new paradigms of the Constitutional State of Rights.
