Study of causes of delay in hearings for application of enforcement measures: food cases, Ecuador

This research addresses were to reform Article 137 of the General Organic Code of Procedures. The objective of the study was determining the causes of delays in hearings related to the enforcement of coercive measures or payment commitments in cases involving child support, with the aim of safeguarding the rights of children and adolescents, and preventing violations of the principle of the best interests of the child. The research employed a mixed-methods approach, with a descriptive-explanatory scope. A non-experimental, cross-sectional design was implemented, using empirical-level methods, theoretical methods, and statistical methods for data processing. As a result, a proposal to amend Article 137 of the General Organic Code of Procedures has been developed to expedite hearings in child support cases and reduce the excessive procedural burden currently faced by the courts. This proposal was reviewed by experts, who validated and confirmed its feasibility and applicability.
