Comparative legal analysis of victims' rights in cases of family abuse in Latin America

Abstract

The study focused on examining and contrasting the legal framework for the protection of the rights of victims of family abuse in Latin America, with the aim of identifying similarities, differences and good practices to improve the effectiveness of protection measures. A mixed approach was used, combining analytical-synthetic, inductive-deductive, historical-logical and dogmatic methods, based on a descriptive, non-experimental and transversal analysis. Information was collected from digital platforms, law journals, university libraries, and websites of relevant institutions. The characteristics of domestic violence and the specific legislations of several countries were analyzed individually, identifying key similarities and differences. The investigation concluded that, although there are significant efforts to protect victims, differences persist in the coverage and treatment of offenders, as well as distrust in the justice system. It was recommended to improve the conditions for the implementation of protection measures, ensure adequate post-suspension follow-up and strengthen support and rehabilitation mechanisms. Good practices in Colombia, Uruguay and Peru were highlighted as models to follow in the region.
