Las personas jurídicas y su responsabilidad penal en Ecuador

Abstract

Uno de los elementos que se le concede importancia en el derecho penal, lo representa sobre quién cae la responsabilidad y culpabilidad sobre el incumplimiento de las acciones que tipificadas en la ley representan un delito. La responsabilidad de las personas jurídicas es un elemento de análisis para el derecho penal. La presente investigación tiene como objetivo realizar un estudio sobre la responsabilidad penal de las personas jurídicas. Se realizó un estudio sobre el estado actual en Ecuador a partir de la puesta en vigor el Código Integral Penal como mecanismo regulatorio de la Responsabilidad Penal de las Personas Jurídicas y como principal resultado se propone un sistema para la recomendación penal, basado en casos.

ABSTRACT

One of the elements that is given importance in criminal law, represents it on who falls the responsibility and guilt for the non-compliance of the actions that typified in the law represent a crime. The liability of legal persons is an element of analysis for criminal law. The present research aims to carry out a study on the criminal responsibility of legal persons. A study was carried out on the current state in Ecuador after the implementation of the Comprehensive Penal Code as a regulatory mechanism for the Criminal Responsibility of Legal Entities and as the main result a system for criminal recommendation, based on cases, is proposed.
