Percepción social del abuso de las reformas constitucionales del estado ecuatoriano.

Resumen

La constitución del país es el resultado de un proceso que unión de varios sectores políticos, sociales, culturales y demás representantes de la sociedad, quienes por unanimidad construyen una constitución, que, revestida de formalidades, es un poder estandarizado, jerarquizado y limitante. La constitución como fuerza activa cambia cuando una persona se desarrolla en sociedad y sus derechos se desarrollan, cambia. Actualmente, sin embargo, las reformas constitucionales tienden a responder a intereses políticos e institucionales que no siempre representan la voluntad del pueblo, por lo que podemos leer las reformas constitucionales como un abuso del poder del gobierno. A través de la metodología jurídica estudiaremos los tipos de poder constituyente y como este da origen una Constitución, cómo es el proceso jurídico-político que da a luz o reforma una Constitución y la importancia del proceso constituyente en el respeto al pacto originario y representatividad de la voluntad soberana.

ABSTRACT

The constitution of the country is the result of a process that brings together various political, social, cultural and other representatives of society, who unanimously build a constitution, which, coated with formalities, is a standardized, hierarchical and limiting power. The constitution as an active force changes when a person develops in society and his rights develop, it changes. Currently, however, constitutional reforms tend to respond to political and institutional interests that do not always represent the will of the people, so we can read constitutional reforms as an abuse of government power. Through the legal methodology we will study the types of constituent power and how this gives rise to a Constitution, how is the legal-political process that gives birth or reforms a Constitution and the importance of the constituent process in respecting the original pact and representativeness of the sovereign will.
