Código Orgánico General de Procesos del Ecuador y su exigencia extralimitada.

Resumen

El presente trabajo de investigación se enfocó en recalcar que la demanda debe reunir los requisitos establecidos en su artículo 142 del Código Orgánico General de Procesos (COGEP) y en caso de determinarse que la misma no es clara o no reúne los requisitos, la o el juzgador ordena que la aclare o complete; por lo que la investigación tuvo como objetivo analizar jurídicamente el requisito de la demanda según el numeral 7 del artículo 142 del Código Orgánico General de Procesos. La modalidad del estudio fue mixta. En este sentido se ha logrado tener un alcance exploratorio y descriptivo, los métodos utilizados han sido el deductivo y el analítico – sintético, teniendo una investigación de carácter documental, de campo y experimental, aplicando técnicas empíricas como la encuesta, entrevista. El principal resultado ha sido que se incurre en la exigencia extralimitada del numeral 7 del artículo 142 del Código Orgánico General de Procesos, concluyendo en que debe estipularse una norma clara y expresa, donde se contemple el proceder en estos casos.

ABSTRACT

The present research work was focused on emphasizing that the claim must meet the requirements established in its article 142 of the General Organic Code of Processes (COGEP) and in case it is determined that the same is not clear or does not meet the requirements, the judge orders it to be clarified or completed; therefore, the research had the objective of legally analyzing the requirement of the claim according to numeral 7 of article 142 of the General Organic Code of Processes. The modality of the study was mixed, in this sense it has achieved to have an exploratory and descriptive scope, the methods used have been the deductive and the analytical - synthetic, having a documentary, field and experimental research, applying empirical techniques such as the survey, interview. The main result has been that the requirement of numeral 7 of article 142 of the General Organic Code of Processes has been exceeded, concluding that a clear and express norm should be stipulated, where the procedure in these cases is contemplated.
