Análisis jurídico al límite de velocidad del transporte público en las carreteras del Ecuador

Resumen

Cuando se transgrede contra el derecho a la vida, y al derecho de las personas usuarias del servicio público, existe vulneración de los artículos 52 y 66 numerales 1, 2 y 3 literal a) de la Constitución de la República del Ecuador. Se ha detectado un grave problema social que está afectando a los ciudadanos usuarios del transporte público interprovincial, como son los accidentes de tránsito en las carreteras. Este trabajo tiene como objetivo: Proponer que se establezcan nuevas políticas por parte del Ministerio de Transporte, donde exija a las compañías de trasporte público interprovincial instalar un dispositivo GPS, para controlar la velocidad, identificar al transporte y al conductor, y que la información que genere el dispositivo sea enviada directamente a la Agencia Nacional de Tránsito. Como uno de los principales métodos, se empleó al Inductivo que permitió realizar un estudio de manera particular y orientar conclusiones generales dentro de la presente investigación respecto de los accidentes de tránsito. Como resultado se expresa que en realidad existe una alta tasa de accidentes de tránsito en el transporte público, a diferencia del de carga, donde se analiza si esto se debe al límite de velocidad establecido para este transporte o porque los choferes tienen mayor cuidado al conducir respetando el límite de velocidad.

ABSTRACT

When the right to life is violated, and the right of users of public service, there is a violation of articles 52 and 66 numerals 1, 2 and 3 literal a) of the Constitution of the Republic of Ecuador. A serious social problem has been detected that is affecting citizens who use interprovincial public transport, such as road traffic accidents. The objective of this work is to: Propose that new policies be established by the Ministry of Transport, where it requires interprovincial public transport companies to install a GPS device, to control speed, identify the transport and the driver, and that the information that generate the device is sent directly to the National Transit Agency. As one of the main methods, the Inductive method was used, which allowed a study to be carried out in a particular way and to guide general conclusions within the present investigation regarding traffic accidents. As a result, it is expressed that there is actually a high rate of traffic accidents in public transport, unlike cargo, where it is analyzed whether this is due to the speed limit established for this transport or because drivers are more careful when driving. respecting the speed limit.
