Analysis of the legal provisions to guarantee safe and orderly migration flows in Ecuador
Abstract
The notion of universal citizenship promotes equal rights and responsibilities for all people, regardless of their origin or geographical location. In Ecuador, a nation with a significant migratory flow, there has been growing interest in the debate on universal citizenship, a concept that challenges traditional borders by promoting equal rights for all, regardless of their origin or immigration status. Hence, the objective of this research, framed in the migration context of Ecuador, is to analyze the legal provisions to guarantee safe and orderly migration flows in the country. An exploratory research was carried out with a qualitative approach. It is concluded that in Ecuadorian legislation, the Constitution and the Human Mobility Law establish the principle of equal rights for all people, regardless of their nationality or immigration status. The existence of deficiencies in the implementation of the Mobility Law in Ecuador represents a significant challenge for the effective protection of the rights of migrants and refugees. In the case of Ecuador, human trafficking represents a threat to the safety and well-being of migrants, especially those in vulnerable situations, such as women and children.
