Exclusión de la antijuridicidad y su errónea aplicación a causa de la presión mediática.

Resumen

En la actualidad, la presión mediática suele perjudicar grandemente a quienes se encuentran inmersos en procesos judiciales. Por ende, el presente trabajo investigativo sobre la errónea aplicación del uso progresivo de la fuerza es una de las causas de exclusión de la antijuridicidad en el caso Olmedo. Tiene como objetivo analizar jurídica y doctrinalmente la facultad que tiene el miembro policial al actuar en cumplimiento de su deber, ante una situación de riesgo y en función de proteger el bien jurídico más preciado: la vida. Se empleó una metodología mixta que conjuga métodos cualitativos y cuantitativos, con información de interés científico, a través del análisis de diferentes artículos científicos y sentencias emitidas por la Corte Constitucional referente al tema. La revisión bibliográfica permitió determinar inconsistencias y falta de sustentación legal de quienes administran justicia, debido a la inobservancia de principios básicos y parámetros establecidos en el uso progresivo de la fuerza. Así también, la manera de accionar del miembro policial cuando actúa en cumplimiento de orden legítima y expresa de autoridad competente o de un deber legal debidamente comprobado.

ABSTRACT

At present, media pressure tends to harm those who are immersed in legal proceedings. Therefore, the present investigative work on the erroneous application of the progressive use of force is one of the causes of exclusion of illegality in the Olmedo case. Its objective is to legally and doctrinally analyze the power that the police member has when acting in the line of duty, in a risk situation and to protect the most precious legal asset: life. A mixed methodology was used that combines qualitative and quantitative methods, with information of scientific interest, through the analysis of different scientific articles and sentences issued by the Constitutional Court regarding the subject. The bibliographic review allowed to determine inconsistencies and lack of legal support of those who administer justice, due to the non-observance of basic principles and parameters established in the progressive use of force. Likewise, the manner of action of the police member when acting in compliance with the legitimate and express order of the competent authority or a duly verified legal duty.
