El Error Inexcusable en Ecuador. Análisis constitucional

Resumen

El error Inexcusable es una infracción gravísima disciplinaria contemplada en el Código Orgánico de la Función Judicial, sin embargo, en Ecuador su definición y elementos no es del todo claro, por tal razón, es importante analizarla desde el punto de vista de la función de los jueces bajo un Estado Constitucional de Derechos y Justicia Social, para comprender que los operadores de justicia pueden ser sancionados por realizar actividades jurisdiccionales y de la misma forma afectar al fundamento de un Estado Garantista. Es por ello, que este trabajo mediante una investigación cualitativa descriptiva busca reflexionar sobre la labor del juez bajo un Estado de estas características, para ello, se analizará la ley y la jurisprudencia nacional como internacional, se contrastará con la misión constitucional de administrar justicia y demostrar que tal sanción en determinados casos, puede ser contradictoria y afectar a la labor del juez como al Estado Constitucional. Además, se examinará los datos del 2019 del Observatorio Judicial Ecuador con la finalidad de demostrar que las destituciones por esta figura son cuantificables en Ecuador.

ABSTRACT

The Inexcusable error is a very serious disciplinary infraction contemplated in the Organic Code of the Judicial Function, however, in Ecuador its definition and elements are not entirely clear, for this reason, it is important to analyze it from the point of view of the role of judges under a Constitutional State of Rights and Social Justice, to understand that justice operators can be sanctioned for carrying out jurisdictional activities and in the same way affecting the foundation of a Guarantor State. That is why, that this work through a qualitative descriptive research seeks to reflect on the work of the judge under a State of these characteristics, for this, the law and national and international jurisprudence will be analyzed and contrasted with the constitutional mission of administering justice and demonstrating that such a sanction in certain cases, can be contradictory and affect the work of the judge as well as the Constitutional State. In addition, the 2019 data of the Judicial Observatory Ecuador in order to demonstrate that the dismissals for this figure are quantifiable in Ecuador.
