Tutela judicial efectiva y la relación con el principio de inmediación

Resumen

En este artículo, se efectuó un breve estudio acerca del tema: el derecho a la Tutela Judicial Efectiva y la relación con el Principio de Inmediación en el Proceso Oral Civil ecuatoriano, el mismo que nace tomando en consideración los cambios dentro del proceso civil, implementados a partir de la aprobación del COGEP en el Ecuador. La investigación tiene como objetivo establecer los efectos jurídicos de la implementación efectiva del principio de inmediación y concentración en el procedimiento oral civil ecuatoriano, con miras a cumplir con las garantías del marco del buen vivir. De tal forma que se aplicó la metodología de la revisión bibliográfica, esbozando conceptos del derecho a la tutela judicial efectiva, y se expone la necesidad de su correcta implementación, en el sistema judicial, lo que no solo conllevó al nivel de la administración de justicia; sino también en la conceptualización misma del proceso como medio para proteger adecuadamente los derechos de las personas. Se analizaron las principales características y su relación con el principio de inmediación y concentración en el proceso oral civil, como consecuencia de las distintas causas que congestionan el sistema procesal civil en nuestro país, y que por ende no dejaron que se cumpla con la garantía constitucional de la tutela efectiva de la justicia con celeridad y economía procesal a la que tienen derecho todas las personas.

ABSTRACT

In this article, he made a brief study on the subject: the right to Effective Judicial Protection and the relation with the Principle of Inmediation in the Ecuadorian Civil Oral Process, the same that is born taking into account the changes within the civil process, implemented to from COGEP approval in Ecuador. The research aims to establish the legal effects of the effective implementation of the principle of immediacy and concentration in the Ecuadorian civil oral procedure, with a view to comply with the guarantees of the framework of good living. Thus, the methodology of the bibliographic review was applied, outlining concepts of the right to effective judicial protection, and the need for its correct implementation in the judicial system is exposed, which not only entailed the level of administration of justice ; but also in the conceptualization of the process as a means to adequately protect the rights of individuals. The main characteristics and their relation to the principle of immediacy and concentration in the civil oral process were analyzed, as a consequence of the different causes that congestion the civil procedural system in our country, and that therefore they did not allow that the constitutional guarantee was fulfilled of the effective protection of justice with speed and procedural economy to which all persons are entitled.
