Maternidad subrogada, cuestionamientos

Resumen

En la actualidad, la maternidad subrogada, se configura como una técnica de maternidad asistida, que, en algunas sociedades es aceptada y regulada. Sin embargo, su aprobación en el resto de sociedades todavía se encuentra en debate, es así como este trabajo propone como objetivo general revisar críticamente la concepción de los derechos fundamentales que están en juego a favor de los hijos e hijas que nacieron por esta técnica. Para tal cometido, se ha utilizado un enfoque cualitativo, pues responde a una investigación descriptiva de tipo revisión bibliográfica, sustentada en los siguientes métodos histórico-lógico, analítico-sintético y el inductivo, los que permiten realizar determinados cuestionamientos con respecto a los derechos de los padres o madres de aquellas personas que nacen a raiz de una maternidad subrogada. Poniendo de esta manera a la palestra pública, una situación real, actual y controversial, que debería ser mejor analizada, para garantizar los derechos fundamentales de las partes que derivan de la dignidad humana.

ABSTRACT

Currently, surrogate motherhood is configured as an assisted motherhood technique, which, in some societies, is accepted and regulated. However, its approval in other societies is still under debate, which is how this work proposes as a general objective Critically review the conception of the fundamental rights that are at stake in favor of the sons and daughters who were born by this technique. For this purpose, a qualitative approach has been used, since it responds to a descriptive investigation of the bibliographic review type, based on the following historical-logical, analytical-synthetic and inductive methods, which allow certain questions to be made regarding the rights of the fathers or mothers of those people who are born as a result of surrogate motherhood. Putting in this way to the public arena, a real, current and controversial situation, which should be better analyzed, to guarantee the fundamental rights of the parties that derive from human dignity.
