Para ello se estudió la doctrina del derecho de identidad, derecho a la filiación, los derechos sexuales y reproductivos reconocidos en la Carta Magna e Instrumentos Internacionales de derechos humanos ratificados por el Estado, con la finalidad de precautelar la tutela judicial efectiva y no vulnerar el derecho a la seguridad jurídica contemplada en el artículo 82 de la Constitución de la República del Ecuador. La investigación contó con un diseño no experimental, transversal, con métodos del nivel teórico del conocimiento, como son el analítico sintético, inductivo deductivo, complementado con el análisis documental método de nivel empírico del conocimiento. Tuvo un alcance descriptivo y explicativo, con lo cual se alcanzó una comprensión integral del problema de estudio. Como resultado de este trabajo, se encuentra un análisis mediante el cual se sintetizó información relevante, compuesta por datos recopilados de diversas fuentes de investigación, clases y costos de los métodos de reproducción humana asistida en el Ecuador, y el vacío legal para regularlos, como se demuestra en las conclusiones.Palabras clave: Reproducción humana asistida, derechos a la identidad y filiación, derechos sexuales y reproductivos, tutela judicial efectiva, seguridad jurídica. ABSTRACTThe current research has like objective to determine the legal vacuum in Ecuador in relation to the regulation assisted human reproduction methods. For which the doctrine of the right of identity, the right to filiation, the sexual and reproductive rights recognized in the Magna Carta and International Instruments of human rights ratified by the State, with the purpose protecting effective judicial protection and not violating the right to legal security contemplated in Article 82 Republic of Ecuador Constitution. The research had a non-experimental, transversal design, with methods of the theoretical level of knowledge, such as the synthetic analytic, inductive deductive, complemented with the documentary analysis method of empirical level of knowledge. This research had a descriptive and explanatory scope, with which a comprehensive understanding of the study problem was achieved. As a result of this work, we found an analysis through which we synthesized relevant information, data collected composed from various research sources, classes and costs of assisted human reproduction methods in Ecuador, and the legal vacuum to regulate them, as demonstrate in the conclusions.Keywords: Assisted human reproduction, rights to identity and filiation, sexual and reproductive rights, effective judicial protection, legal security.
